My name is Michelle Daniel. I am a Montgomery, Alabama resident who signed a gym membership and personal training agreement with Amped Fitness Montgomery in August and September 2025. What followed was months of charges for services that were never professionally delivered, a cancellation request that was denied without any notification to me, and a management team that has now contradicted its own written admission while demanding I repay bank chargebacks my financial institution already approved.
I have been denied a refund. I am moving forward with small claims court, regulatory complaints with the FTC, Alabama Attorney General, and CFPB, notification to the fire department and city, and contact with Amped Fitness's insurance carrier. Management Texted That My Membership Was Cancelled
I have a text message from Amped Fitness management explicitly stating that my membership was cancelled. District Manager Michael Manning is now claiming in email that my membership is still active. These two communications directly contradict each other. This text message is retained in its entirety and will be submitted as evidence in my small claims filing and to all regulatory agencies.
Verbally Denied Gym Entry Until Balance Was Paid
I was told by an Amped Fitness representative on the phone that I could not enter the gym until a past due balance was paid. Under Alabama consumer protection law, a business cannot use denial of contracted services as a debt collection mechanism. This is being reported as a potential violation to the Alabama Attorney General and the Consumer Financial Protection Bureau.

The official invoice provided by Amped Fitness in this dispute is generated from "Amped Fitness Columbus — 5300 Sidney Simmons Blvd, Columbus GA 31904." My agreement was signed at the Montgomery, AL location. I have formally demanded an explanation for this discrepancy and whether Georgia consumer protection laws apply to my billing relationship.

No Staff After 7PM — Women Left Alone
I Do Not Feel Safe Returning to This Facility
Amped Fitness has suggested I return to use my remaining sessions as resolution. I am formally rejecting this. As a woman, I do not feel safe returning to Amped Fitness Montgomery under any circumstances.
Staff leave at approximately 7:00 PM. After that, women exercising alone are left with no staff, no security, no emergency responder, and no verified control over who enters the building. I have personally witnessed people tailgating through the door during unstaffed hours. Anyone can walk in.
I am contacting Amped Fitness's insurance carrier, the Montgomery Fire Department, and the City of Montgomery about these conditions.
No Emergency Response
No CPR-trained staff after 7PM. If a woman suffers a cardiac event or is injured after hours she may be completely alone with no trained person to help.
Unauthorized Entry — Tailgating
I personally witnessed people entering by following members through the door during unstaffed hours. No one to stop it. No way to know who is inside.
Women Alone at Night
Women members are regularly alone in this facility after 7PM with zero staff oversight and no verified control over who else may be present in the building.
Fire & Emergency Gaps
No trained staff to enforce fire evacuation, assist members in emergencies, or contact emergency services on behalf of members after 7PM. The Fire Department is being notified.
