"I paid over $800 to Amped Fitness Montgomery. I received one personal training session. I have been denied a refund. I do not feel safe returning. I am now taking every legal and regulatory action available to me — and I am not alone."

My name is Michelle Daniel. I am a Montgomery, Alabama resident who signed a gym membership and personal training agreement with Amped Fitness Montgomery in August and September 2025. What followed was months of charges for services that were never professionally delivered, a cancellation request that was denied without any notification to me, and a management team that has now contradicted its own written admission while demanding I repay bank chargebacks my financial institution already approved.

I have been denied a refund. I am moving forward with small claims court, regulatory complaints with the FTC, Alabama Attorney General, and CFPB, notification to the fire department and city, and contact with Amped Fitness's insurance carrier. I have 7 people supporting this effort — including a former Amped Fitness employee with direct knowledge of internal practices at this location.

Additional Documented Violations

Since my initial correspondence with Amped Fitness management, I have obtained additional documented evidence that is being submitted to all regulatory agencies and the court.

Text Message Evidence

Management Texted That My Membership Was Cancelled

I have a text message from Amped Fitness management explicitly stating that my membership was cancelled. District Manager Michael Manning is now claiming in email that my membership is still active. These two communications directly contradict each other. This text message is retained in its entirety and will be submitted as evidence in my small claims filing and to all regulatory agencies.

Potential Legal Violation

Verbally Denied Gym Entry Until Balance Was Paid

I was told by an Amped Fitness representative on the phone that I could not enter the gym until a past due balance was paid. Under Alabama consumer protection law, a business cannot use denial of contracted services as a debt collection mechanism. This is being reported as a potential violation to the Alabama Attorney General and the Consumer Financial Protection Bureau.

Billing Discrepancy

Invoice Generated from Columbus, Georgia — Not Montgomery, Alabama

The official invoice provided by Amped Fitness in this dispute is generated from "Amped Fitness Columbus — 5300 Sidney Simmons Blvd, Columbus GA 31904." My agreement was signed at the Montgomery, AL location. I have formally demanded an explanation for this discrepancy and whether Georgia consumer protection laws apply to my billing relationship.

Witness

Former Amped Fitness Employee — Will Provide Statement

A former Amped Fitness employee with direct knowledge of internal practices at this location has come forward and is aligned with this consumer advocacy effort. This individual is prepared to provide a formal statement to regulatory agencies and the court regarding practices they personally witnessed during their employment.

No Staff After 7PM — Women Left Alone

I Do Not Feel Safe Returning to This Facility

Amped Fitness has suggested I return to use my remaining sessions as resolution. I am formally rejecting this. As a woman, I do not feel safe returning to Amped Fitness Montgomery under any circumstances.

Staff leave at approximately 7:00 PM. After that, women exercising alone are left with no staff, no security, no emergency responder, and no verified control over who enters the building. I have personally witnessed people tailgating through the door during unstaffed hours. Anyone can walk in.

I am contacting Amped Fitness's insurance carrier, the Montgomery Fire Department, and the City of Montgomery about these conditions.

🚨

No Emergency Response

No CPR-trained staff after 7PM. If a woman suffers a cardiac event or is injured after hours she may be completely alone with no trained person to help.

🚪

Unauthorized Entry — Tailgating

I personally witnessed people entering by following members through the door during unstaffed hours. No one to stop it. No way to know who is inside.

👩

Women Alone at Night

Women members are regularly alone in this facility after 7PM with zero staff oversight and no verified control over who else may be present in the building.

🔥

Fire & Emergency Gaps

No trained staff to enforce fire evacuation, assist members in emergencies, or contact emergency services on behalf of members after 7PM. The Fire Department is being notified.

Safety Concern

"As a woman who went to this gym regularly in the evening, the lack of any staff after 7PM always made me uncomfortable. There were multiple times I was in the gym alone late at night with no way to reach anyone if something happened. I stopped going because of this."

Former Amped Fitness Montgomery Member — Name withheld, identity confirmed
Billing Dispute

"I was charged for months after I cancelled my membership. Every time I called they told me something different. It took months to resolve and they never apologized or refunded the extra charges. I support this petition fully."

Demand Accountability from Amped Fitness Montgomery

We are calling on Amped Fitness Montgomery to: (1) issue a full refund to Michelle Daniel for undelivered personal training services, (2) implement proper after-hours safety measures including emergency call systems and verified access control, (3) adopt a transparent and fair cancellation process that complies with the FTC's Click-to-Cancel Rule, and (4) stop the practice of denying member access as a debt collection mechanism.

Your name and city will be shown on the petition count. Your experience is kept confidential unless you specifically give permission to share it. By signing you confirm your statement is truthful and based on your own experience.

✓ Thank you for signing. Your support has been recorded. If you shared an experience, it will be reviewed and may be added to the witness section with your permission. All Actions Being Taken Simultaneously

Amped Fitness had every opportunity to resolve this. They chose not to.

I have been denied a refund for services I paid for and never received. Their management has contradicted written admissions, demanded repayment of bank chargebacks, and suggested I return to a facility where I do not feel safe as a woman. Every action below is being executed today. Every agency is receiving a complete documentation package.

01

Small Claims Court

Filing at Montgomery County District Court, 251 S. Lawrence St, Montgomery AL. Full amount of undelivered services plus filing costs. All documentation ready.

02

Federal Trade Commission

Filing at ReportFraud.ftc.gov. FTC is actively investigating gym chains for these exact practices right now.

03

Insurance Carrier

Reporting safety concerns — unstaffed after-hours operation, tailgating, no emergency infrastructure — to Amped Fitness's general liability insurance carrier. Requesting certificate of insurance.

04

Montgomery Fire Department

Reporting fire safety and emergency evacuation protocol concerns at (334) 241-2600. A 24/7 facility with no staff after 7PM has no trained personnel for building emergencies.

05

City of Montgomery

Contacting business licensing regarding whether unstaffed after-hours operation complies with local safety ordinances and occupancy requirements.

06

Local News Media

WSFA 12, WAKA Action 8, WCOV FOX 20, Montgomery Advertiser, and AL.com receiving full documentation. Women's safety at an unstaffed gym is a community story.

07

Alabama Attorney General

Filing under the Alabama Physical Fitness Services Act at consume@ago.state.al.us. State law specifically protects gym members from these billing practices.

08

CFPB Re-Escalation

Re-filing with the Consumer Financial Protection Bureau using Amped Fitness's own invoice as new evidence confirming sessions were purchased and never delivered.
